Immigration is the movement of individuals to a new destination country either as legal immigrants or through naturalization process where they don’t have citizenship or permanent resident status in order to permanently settle as full citizens or even naturalized citizens in that country. In the modern era immigration is usually associated with migration but in past years it was an element of trade that took place between countries. The coming into force of the Immigration laws of the country and the registration of immigrants have led to the variety of immigration categories today.

 Some of the major categories include: Family immigration, Employment immigration, humanitarian immigration, Green card/ Permanent residency immigration, Unlawful immigrant status, Criminal immigrant status and category E immigration.

Immigration laws lay down the rules and regulations for the legal immigration status of individuals. It has become one of the most significant decisions of the government towards the policy and practice regarding immigration. It has been an issue on which the governments of both the federal and the state level has taken a decision regarding the regulation of immigration. There are many categories under which immigration can be divided; as per the legislation immigration status of an individual also depends upon his social security number or any other identification issued by the federal government or state government. The main purpose behind the formulation of the Immigration laws is to regulate the migration and the legal and social status of the immigrants residing in United States.

Immigrants can come to United States; by different means such as by securing visa over some country such as Australia, Canada, Mexico, South Africa, Germany etc. Many people who want to come to United States for the sake of job opportunity cannot leave their present job because according to the new start up laws, every immigrant must leave his job and only if he can show that his financial requirement as well as his requirements for education and job search are so much that his departure will be well justified. There is no bar to change the work agreement or contract once you migrate to United States, but if you are planning to bring your family with you then it must be according to the new immigration laws. The process of immigration can be fast too as almost all the required documents are required to be fulfilled by the immigrants before they can come to the nation.

Many times when people migrating to United States find difficulty in obtaining naturalization or visa of citizenship as there is no systematic procedure followed for immigration status.

  • They can go to the foreign country for obtaining documentation about their legal rights and privileges for staying legally in that country, but they may not get proper assistance in terms of obtaining visa over there.
  • If any person having valid reasons for not attaining the right of visa over there can approach the U.S. embassy for getting help in this regard but the request must be forwarded through a registered agent.

Another group of immigrants; who are trying to obtain visa over there is the illegal aliens. The government officials of different states do not accept the claim of illegal immigrants that they have come from another country to provide them this facility of naturalization. The main reason behind this policy is that each state has its own policy in this regard and if a citizen of any state cannot become a citizen of the other state, they would not be able to become citizens of the nation as such. There are many states which allow the citizens of the same state to apply for the right of immigrants but if they cannot qualify for this option then they have no option left to apply for it.

Immigrants are one of the most important sources of development; in the country. Its population comprises of skilled and semi-skilled workers and even the business community also contributes in this regard. It is true that the country is facing many challenges but still it strives hard to attain the highest level of growth in the field of technology and infrastructures. Immigration is indeed a very important issue and the government of United States has to promote it vigorously in order to protect the interests of the immigrants and to also encourage more immigrants to settle in the country under the green card scheme.
